Section 35
Voluntary Retirement

(1) Civil servants who have reached the age limit of 50 years and are eligible for pension can take voluntary retirement within the period specified in the notification published in the Nepal Gazette by the Government of Nepal under the conditions mentioned in the same notification. In this way, among the employees who take voluntary retirement, in the case of those who entered the civil service before 21st Kartik 2049, not exceeding sixty years of age, and in the case of entering the civil service after that date, not exceeding eighty years of age, the total service period for pension is added to a maximum of seven years. will be maintained. However, in the case of employees who are on layoff or who are not required by the government of Nepal, they can apply for voluntary retirement by publishing a notice in the Nepal Gazette with separate facilities and conditions.
(2) Notwithstanding anything written in sub-section (1), if an employee who has reached the age limit of fifty years and the condition of receiving pension wishes to take voluntary retirement, in accordance with this Act, in the position one grade above, section 20A. If he gets promoted according to the above, he can take voluntary retirement after completing the service period of sub-section (3) of section 37.
